§ 9.04.020. Assault and battery

  • Any person who:

    A. Attempts to cause bodily injury to another, and has the actual ability to cause the injury;

    B. Recklessly causes bodily injury to another;

    C. Negligently causes bodily injury to another with a dangerous weapon; or

    D. Attempts by physical menace to put another in fear of imminent serious bodily harm, with or without the actual ability to seriously harm the other person;

    is guilty of assault and battery. "Battery" is defined in subsections B and C of this section. "Assault" is defined in subsections A and D of this section.
