§ 16.08.020. Final plats

  • A subdivider or developer may at any time submit a final plat to the common council for final approval subject to the following terms and conditions:

    A. The common council shall act upon such final plat within ninety (90) days after the submission of said plat for approval. (SDCL Section 11-6-32)

    B. Prior to approval by the city council, the city engineer or city superintendent must approve the same.

    C. The plat must be submitted in the form of an original tracing together with not less than three black or white prints, which drawings must be submitted to the finance officer at least seven days prior to the date of a regular city council meeting.

    D. The final plat shall have incorporated in it all changes, modifications or recommendations required by the city engineer or city superintendent, and the common council in the event a preliminary plat was submitted.

    E. The final plat shall be accepted by a statement from the city engineer or city superintendent that he or she has received a copy of the plat showing thereon all utilities, exact location, elevation, and itemizing those portions of the utility service already installed, and those to be installed, and that the subdivider or developer has otherwise complied with the requirements of this title.

    F. Upon final approval of the plat by the common council, separate copies of the final plat shall be filed with the city finance officer, the city engineer and the city council.

    G. Upon final approval, the final plat shall be filed by the city finance officer with the register of deeds of Pennington County, South Dakota, as provided for by law, and shall file evidence of such recording in the office of the city finance officer.
